Litigation & Commercial Arbitration
A dispute requires a clear understanding of what happened, the parties’ positions, and the documents that support or contradict each account. Cedeño Law’s litigation and commercial arbitration practice concerns the assessment and handling of disputes within the relevant legal framework. The starting point is the actual issue requiring resolution.
Prepare a factual timeline and provide the relevant agreements, correspondence, payment records, and other available evidence. Include information that may be unfavourable to your position, as well as the facts on which you rely. Preserve complete records and identify any missing material so that the assessment is based on a balanced account.
Where a contract contains a dispute-resolution provision, provide the full agreement for review. The wording of the provision, the nature of the dispute, and any steps already taken may be relevant to discussing the available course. Court proceedings and commercial arbitration should not be treated as interchangeable processes or described as offering a guaranteed outcome.
If you have received a demand, summons, notice, or order, provide the complete document promptly and state when and how it was received. Explain your objectives and any approaching hearing or other important date. The scope of any engagement, immediate responsibilities, and further work should be clarified with the firm after the matter has been assessed.
