Settling a Philippine Estate: Tax Filing, Heirs, and Transfer of Registered Property
The death of a property owner does not automatically place the title in the heirs’ names. The family must identify the estate’s assets and liabilities, establish the persons entitled to inherit, comply with tax obligations, and document the partition or other lawful transfer. These steps should be planned together; a tax payment by itself does not resolve ownership disputes among heirs.
Begin with the family and asset record
Counsel should review the death certificate, marriage and birth records, any will, property titles, tax declarations, bank and share records, debts, and prior transfers. The deceased person’s residence and the location of each asset matter to the tax filing and transfer process. Foreign documents or heirs abroad can add authentication and representation requirements.
Determine the proper settlement instrument
Where the legal conditions permit it, heirs may execute an extrajudicial settlement; a judicial proceeding may be needed when there is a will, a disputed heirship or partition, or another issue that cannot be resolved privately. The instrument should accurately describe the assets and the allocation agreed upon. An omitted asset or heir can create later title and tax problems.
File the estate tax return using the applicable rules
The BIR’s Form 1801 instructions identify the executor, administrator, or legal heirs who may be responsible for filing and list the core supporting records. Different rules can apply to deaths in different years and to older estates potentially covered by a special amnesty. The family should verify the current deadline, valuation, deductions, and RDO before filing rather than use a generic online calculator.
Separate tax payment from title transfer
For registered or registrable property, the BIR clearance needed for transfer must be obtained before the Registry of Deeds or other registry can complete the change. BIR guidance on estate-tax amnesty expressly distinguishes filing and payment from the later proof of settlement required for an electronic Certificate Authorizing Registration. The same practical distinction helps families plan documents in an ordinary estate.
