Philippine Property Transfers: Why the BIR eCAR Must Match the Deed and Title
Signing and notarizing a deed of sale is a central step in a Philippine property transaction, but it does not by itself put a new owner’s name on the title. Tax reporting, BIR processing, local transfer requirements and registration with the Registry of Deeds must be coordinated. Errors in a name, property description or consideration can surface late in that chain.
The eCAR supports registration of the transfer
The Bureau of Internal Revenue describes the electronic Certificate Authorizing Registration, or eCAR, as evidence that a property transfer was reported and the required taxes paid. Revenue Regulations No. 12-2024 addresses the validity and revalidation of the certificate. The BIR’s Citizen’s Charter lists the processing services and documentary requirements for an original eCAR in sale, donation and estate transactions.
Before tax filing, compare the deed with the title, tax declaration, identification records and agreed transaction terms. Confirm the property’s location and the proper BIR office for the transaction. The BIR’s RMC No. 56-2024 explains that eCAR processing for a sale of real property is handled by the RDO with jurisdiction over the property’s location, regardless of where the tax return and payment were made.
Plan the entire transfer
Determine which party must prepare and file each document and who will bear the applicable taxes and expenses under the contract and law. Set a realistic closing schedule for BIR review, any correction or revalidation, local transfer tax and Registry of Deeds submission. A buyer should also investigate title annotations, possession, condominium restrictions where relevant, and the seller’s authority before releasing funds.
